US NATIONWIDE ONSITE SERVICES POLICY

This Onsite Services, Device Pickup, Transportation & Repair Policy (“Policy”) governs onsite appointments, device pickups, transportation, inspections, diagnostics, repairs, installations, troubleshooting, consulting, and related in-person services performed by StarByte IT LLC, a California limited liability company doing business as StarByte (“StarByte,” “we,” “our,” or “us”).

This Policy applies to services performed at client residences, businesses, offices, commercial facilities, data centers, temporary sites, event venues, and other mutually agreed-upon locations within the United States.

By requesting, scheduling, purchasing, or authorizing services; signing a StarByte service authorization or device check-in form; submitting payment; or electronically accepting this Policy, the client (“Client”) acknowledges that they have read, understood, and agree to these terms.

1. Service Authorization & Availability

1.1

Client authorizes StarByte to perform the services described in the applicable service request, estimate, invoice, work order, service authorization, device check-in form, or other written agreement.

1.2

StarByte may provide services at locations designated or approved by Client within the United States, including residences, offices, commercial facilities, data centers, temporary sites, and event venues.

1.3

Client acknowledges that StarByte personnel may travel within California or interstate when necessary to perform authorized services.

1.4

Nothing in this Policy obligates StarByte to provide services in any particular geographic area or accept any particular service request.

1.5

StarByte may determine, in its reasonable discretion, whether a requested service can be appropriately performed onsite or whether additional offsite diagnostics, repair, equipment, parts, or facilities are required.

2. Scope of Services

2.1

Services may include, but are not limited to:

  • Hardware installation, repair, replacement, and troubleshooting;

  • Computer and device diagnostics;

  • Network setup, configuration, cabling, and diagnostics;

  • Software installation, deployment, configuration, and troubleshooting;

  • Operating system troubleshooting and remediation;

  • System assessments and consulting;

  • Performance troubleshooting and optimization;

  • Peripheral and accessory installation;

  • Data-related troubleshooting or migration when specifically authorized;

  • Equipment pickup and transportation;

  • Equipment cleaning and maintenance; and

  • Other technology services agreed upon between StarByte and Client.

2.2

Services are limited to the authorized scope of work.

2.3

Additional requests or problems discovered during service may require additional authorization, fees, parts, service time, or a separate appointment.

3. Onsite Service & Assessment

3.1

StarByte may perform an initial inspection, assessment, troubleshooting, diagnostic procedure, repair, installation, or other authorized service at Client’s home, business, or another agreed-upon location.

3.2

If an issue cannot reasonably or safely be resolved onsite, StarByte may recommend that the device be transported to another appropriate service location for additional diagnostics or repair.

3.3

StarByte will not remove Client equipment from the service location without Client authorization.

3.4

An onsite assessment or diagnostic service does not guarantee that StarByte will identify every existing or potential problem with the device, system, network, or surrounding infrastructure.

4. Device Pickup & Transportation Authorization

4.1

When Client authorizes StarByte to take possession of equipment, Client authorizes StarByte to:

  • Take temporary possession of the device or equipment;

  • Remove it from the authorized pickup location;

  • Transport it using reasonable transportation methods;

  • Inspect, diagnose, test, and troubleshoot the reported issue;

  • Transport it to an appropriate service location;

  • Perform specifically authorized services; and

  • Return the equipment following completion or termination of the authorized service.

4.2

StarByte will take reasonable precautions when handling, storing, and transporting Client equipment.

4.3

Transportation authorization applies only to equipment and accessories documented or otherwise specifically identified as being received by StarByte.

5. Device Check-In & Condition Documentation

5.1

At or before pickup, StarByte may document information including:

  • Manufacturer and model;

  • Serial number, service tag, or other identifying information;

  • Visible physical condition;

  • Existing scratches, dents, cracks, missing components, or other damage;

  • Accessories received;

  • Reported symptoms or problems;

  • Device configuration information; and

  • Photographs or video of the device, accessories, and visible condition.

5.2

Client is responsible for reviewing check-in information presented to them and notifying StarByte of inaccuracies before signing or approving the applicable service authorization when reasonably possible.

5.3

StarByte is not responsible for pre-existing damage, ordinary wear and tear, cosmetic deterioration, hidden defects, manufacturing defects, aging components, or failures unrelated to services performed by StarByte.

5.4

Client should identify any unusually fragile, sensitive, valuable, damaged, or restricted equipment or property before service begins.

6. Access & Work Environment

6.1

For onsite services, Client agrees to provide StarByte personnel with reasonably safe, lawful, and unobstructed access to the equipment and work areas necessary to perform the authorized services.

6.2

Where applicable, Client should provide:

  • Adequate lighting;

  • Reasonable ventilation;

  • Sufficient workspace;

  • Reliable electrical power;

  • Internet or network access when necessary; and

  • Permission to access areas reasonably required for the authorized service.

6.3

Client is responsible for securing pets and keeping children, guests, customers, employees, or other unauthorized individuals from materially interfering with the work area.

6.4

StarByte may refuse, suspend, or discontinue services if site conditions are unsafe, unsanitary, hostile, unlawful, inaccessible, or materially interfere with StarByte’s ability to perform the service safely and effectively.

7. Safety & Hazardous Conditions

7.1

StarByte is not responsible for hazardous or defective conditions existing before service, including but not limited to:

  • Faulty electrical wiring or grounding;

  • Damaged electrical outlets;

  • Structural defects;

  • Water intrusion or water damage;

  • Mold or other environmental hazards;

  • Excessive dust or debris;

  • Pest infestations;

  • Unsafe equipment installations;

  • Damaged cabling;

  • Improper modifications performed by others; or

  • Other conditions outside StarByte’s reasonable control.

7.2

StarByte may immediately stop work or leave a service location if StarByte reasonably determines that continuing work would create a safety, legal, security, or property risk.

7.3

Stopping work because of unsafe or prohibited conditions does not automatically waive charges for travel, assessment, labor, parts, or other services already provided or incurred.

8. Data, Backups & Risk of Data Loss

8.1

Client is responsible for maintaining a current backup of important files, software, settings, credentials, and other data before StarByte performs service whenever reasonably possible.

8.2

Client acknowledges that computer diagnostics, troubleshooting, repair, software modification, hardware replacement, storage-device work, malware remediation, operating-system repair, and similar technology services inherently may involve risk of hardware failure, software corruption, configuration changes, or data loss.

8.3

Although StarByte will take reasonable care when handling Client equipment and data, StarByte does not guarantee that Client data can be preserved, recovered, or restored during or following service.

8.4

Client should inform StarByte before service if a device contains particularly important, irreplaceable, confidential, or unbacked-up data.

8.5

To the maximum extent permitted by applicable law, StarByte is not responsible for data loss or corruption resulting from pre-existing device conditions, hardware failure, software failure, malware, defective storage media, Client actions, third-party products or services, or circumstances outside StarByte’s reasonable control.

8.6

Nothing in this section excludes liability that cannot legally be excluded under applicable law.

9. Passwords, Credentials & Device Access

9.1

Certain services may require access to Client’s operating system, firmware, BIOS/UEFI, software, network, user account, or other device functions.

9.2

Client may provide temporary credentials or otherwise authorize access when reasonably necessary to perform the requested service.

9.3

StarByte will use credentials provided by Client only as reasonably necessary to perform authorized services.

9.4

StarByte will not intentionally access unrelated personal files, communications, accounts, photographs, documents, or other private information except when reasonably necessary for troubleshooting or when specifically authorized by Client.

9.5

Client is responsible for ensuring that they have authority to provide StarByte with access to any device, account, network, software, or information involved in the service.

10. Diagnostics & Corrective Work

10.1

Diagnostic and assessment procedures may require StarByte to reseat, reconnect, remove, reinstall, reset, configure, update, test, or otherwise manipulate hardware or software components to identify the cause of a reported problem.

10.2

In some circumstances, a diagnostic procedure itself may correct or substantially resolve the reported problem.

10.3

The fact that a problem is corrected, reduced, or resolved during diagnosis does not make the diagnostic or corrective work free of charge unless StarByte specifically represented that the applicable work would be provided without charge.

10.4

Where a complimentary or free diagnostic assessment is offered, the complimentary portion is limited to evaluating or identifying the reported problem unless StarByte expressly states otherwise.

10.5

If troubleshooting requires corrective action, repair labor, configuration changes, component reseating, firmware or BIOS/UEFI resets, reassembly, verification testing, or other work beyond the complimentary diagnostic scope, StarByte may charge for that work after obtaining Client authorization where required.

11. Additional Repairs, Services & Authorization

11.1

An initial assessment may reveal additional problems, repairs, replacement parts, configuration changes, or services that were not reasonably apparent when service was initially authorized.

11.2

StarByte will inform Client of additional billable work and obtain authorization before performing work materially outside the previously approved scope.

11.3

Client is not obligated to approve additional recommended services.

11.4

Declining additional work does not eliminate Client’s responsibility for authorized diagnostics, travel, transportation, labor, parts, or other services already performed or incurred.

12. Parts & Replacement Components

12.1

When replacement parts are required, StarByte will provide applicable pricing, estimates, or other cost information for Client approval before ordering or installing billable components unless otherwise agreed upon.

12.2

Parts availability, manufacturer availability, shipping times, supplier delays, backorders, discontinued products, compatibility issues, and other circumstances outside StarByte’s reasonable control may affect estimated completion dates.

12.3

Replacement components may be new, refurbished, remanufactured, or otherwise identified to Client as applicable.

12.4

Manufacturer warranties, where applicable, remain subject to the applicable manufacturer’s terms.

13. Scheduling, Travel & Service Fees

13.1

Onsite services generally require confirmed scheduling.

13.2

Applicable charges may include:

  • Service-call fees;

  • Onsite assessment fees;

  • Diagnostic fees;

  • Labor charges;

  • Pickup and return fees;

  • Transportation fees;

  • Travel time;

  • Mileage;

  • Airfare;

  • Lodging;

  • Parking or tolls;

  • Shipping;

  • Minimum service durations;

  • Parts and materials; and

  • Other disclosed expenses reasonably associated with the authorized service.

13.3

Applicable fees will be communicated through an estimate, invoice, checkout screen, service authorization, written communication, or other reasonable disclosure.

13.4

Delays caused by Client unavailability, access problems, inaccurate information, site conditions, or circumstances within Client’s reasonable control may result in additional charges when disclosed and permitted by applicable law.

13.5

Previously paid service-call, assessment, pickup, delivery, or transportation fees are separate from subsequent diagnostic, labor, repair, and parts charges unless StarByte expressly states otherwise.

14. Payment

14.1

Applicable onsite service, transportation, diagnostic, repair, labor, parts, materials, and other authorized charges will be communicated to Client as applicable.

14.2

Unless otherwise agreed upon in writing, payment for completed repair or service work is due before or at the time the serviced equipment is returned to Client.

14.3

Certain service-call, assessment, travel, transportation, parts, deposit, or other fees may be required before service begins or before equipment is picked up.

14.4

Client remains responsible for authorized charges for services actually performed even when the service does not result in a complete repair, provided the applicable charges were properly authorized or disclosed.

14.5

If authorized diagnostic or troubleshooting procedures successfully correct the reported problem, applicable labor or repair charges may still apply as described in Section 10.

15. Accessories & Personal Items

15.1

StarByte is responsible only for accessories and other items specifically documented as received.

15.2

Clients should retain accessories not reasonably required for diagnosis or repair, including carrying cases, external storage devices, adapters, cables, peripherals, removable media, and other personal items.

15.3

Client should not provide unnecessary sensitive documents, cash, jewelry, identification documents, or other unrelated personal property with equipment submitted for service.

16. Estimated Completion & Turnaround Times

16.1

Any completion date, appointment duration, return date, or turnaround time provided by StarByte is an estimate unless expressly guaranteed in writing.

16.2

Completion may be affected by:

  • Diagnostic complexity;

  • Parts availability;

  • Manufacturer or vendor delays;

  • Shipping delays;

  • Additional problems discovered during service;

  • Client authorization delays;

  • Software or hardware complications; or

  • Other circumstances outside StarByte’s reasonable control.

16.3

StarByte will make reasonable efforts to inform Client of significant delays.

17. Completed & Unclaimed Devices

17.1

StarByte will make reasonable efforts to notify Client when service is complete, service has been discontinued, or equipment is ready to be returned.

17.2

Client agrees to make reasonable arrangements for return or collection of the equipment within 30 days following notification.

17.3

Equipment remaining unclaimed may be subject to reasonable storage fees following appropriate notice to Client and only to the extent permitted by applicable law.

17.4

Nothing in this Policy permits StarByte to dispose of, sell, transfer, retain ownership of, or otherwise assume ownership of Client property except as permitted by applicable law.

18. Right to Refuse, Suspend or Discontinue Service

18.1

StarByte reserves the right to refuse, suspend, or discontinue service when reasonably necessary, including when:

  • Conditions are unsafe, hostile, threatening, unsanitary, or unlawful;

  • Requested services exceed the agreed scope and additional authorization cannot be obtained;

  • Client behavior is abusive, threatening, discriminatory, harassing, or otherwise inappropriate;

  • StarByte reasonably believes the requested service would violate law, regulation, contractual restrictions, intellectual-property rights, security requirements, or StarByte policy;

  • Required access or authorization cannot be provided;

  • Continuing the service would create an unreasonable risk to persons, property, equipment, data, or systems; or

  • Client materially breaches applicable service terms.

18.2

Refusal, suspension, or discontinuation of service does not waive payment obligations for authorized services already rendered, parts ordered with Client authorization, or reasonable travel or transportation costs already incurred.

19. Client Property & Third-Party Conditions

19.1

StarByte is not responsible for damage or failure caused by hidden defects, aging infrastructure, defective components, improper prior repairs, unsupported configurations, manufacturer defects, or normal wear and tear.

19.2

StarByte cannot guarantee the functionality, reliability, compatibility, or continued operation of third-party hardware, software, services, networks, accounts, platforms, or infrastructure.

19.3

Repairs or modifications to one component may reveal unrelated or previously hidden failures in another component. The discovery of such conditions does not, by itself, establish that StarByte caused the condition.

20. Limitation of Liability

20.1

To the maximum extent permitted by applicable law, StarByte is not liable for indirect, incidental, special, exemplary, or consequential damages arising from or relating to services performed, including losses resulting from equipment failure, downtime, loss of use, lost profits, software issues, data loss, pre-existing conditions, third-party products or services, or circumstances outside StarByte’s reasonable control.

20.2

Any additional limitation of liability or indemnification terms contained in an applicable StarByte agreement, service authorization, or Limitation of Liability & Indemnification Agreement will apply to the extent enforceable and not inconsistent with mandatory law.

20.3

Nothing in this Policy excludes or limits liability for gross negligence, willful misconduct, or any other liability that cannot legally be excluded or limited under applicable law.

21. Client Representations & Authorization

By requesting or authorizing service, Client represents and confirms that:

  • Client is the owner of the equipment or has authority from the owner to request and authorize the service;

  • Client has authority to provide StarByte with access to applicable devices, systems, networks, software, accounts, and locations;

  • Device and accessory information provided to StarByte is accurate to the best of Client’s knowledge;

  • Client authorizes StarByte to perform the services described in the applicable service request;

  • Client authorizes reasonable diagnostic and testing procedures necessary to perform those services;

  • Client authorizes StarByte to take temporary possession of and transport equipment when indicated in the applicable authorization;

  • Client understands that additional work outside the authorized scope may require additional approval and charges; and

  • Client acknowledges and agrees to this Policy.

22. Acceptance & Electronic Consent

22.1

Client may accept this Policy by signing a service authorization or check-in form, electronically accepting an agreement, requesting or authorizing covered services, or submitting payment where the Policy is presented or linked as part of the transaction.

22.2

Where permitted by applicable law, Client agrees that an electronic signature, electronic acceptance, or other legally recognized electronic consent has the same force and effect as a handwritten signature.

22.3

Electronic transactions and signatures may be governed by applicable federal and state electronic-transactions laws, including the U.S. Electronic Signatures in Global and National Commerce Act (“ESIGN Act”) and applicable versions of the Uniform Electronic Transactions Act.

23. Policy Updates

23.1

StarByte may update this Policy periodically.

23.2

Changes will be identified by a revised “Last Updated” date.

23.3

The version presented, provided, or linked to Client at the time the applicable service is authorized will govern that service unless otherwise agreed upon in writing or required by law.

24. Governing Law

24.1

This Policy and services governed by it will be governed by the laws of the State of California, without regard to conflict-of-law principles, to the maximum extent permitted by applicable law.

24.2

For services performed outside California, StarByte will comply with applicable mandatory local laws, safety requirements, licensing requirements, and regulations that cannot legally be waived or superseded by agreement.

24.3

Nothing in this Policy is intended to deprive Client of any non-waivable consumer protection or other right provided by applicable law.

25. Venue & Jurisdiction

To the maximum extent permitted by applicable law, any dispute arising from or relating to this Policy or services governed by it shall be brought in the appropriate state or federal court located in Sacramento County, California, and Client consents to the jurisdiction of such courts.

This provision does not apply where applicable law gives Client a non-waivable right to bring a claim in another jurisdiction or forum.

26. Severability

If any provision of this Policy is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it enforceable where permitted, and the remaining provisions will continue in full force and effect.

27. Entire Policy & Related Agreements

This Policy supplements applicable StarByte estimates, invoices, service authorizations, check-in forms, statements of work, and other service-specific agreements.

If a service-specific written agreement expressly conflicts with this Policy, the more specific provision will control for that service unless prohibited by applicable law.
