1. Scope

This Privacy Policy applies to all services, products, and communications offered by StarByte, including IT support, consulting, managed services, software deployments, and backup solutions.

2. Information We Collect

  • Technical Information: Device details, system configuration, operating system version, IP addresses, diagnostic logs, usage data, and error reports collected during troubleshooting or monitoring.

  • Website & Cookies: Usage data collected via cookies, analytics tools (such as Google Analytics and Wix Analytics), and marketing pixels (such as Google Ads or Meta/Facebook Pixel).

We do not knowingly collect information from individuals under the age of 18.

3. How We Use Information

We use information to:

  • Deliver, manage, and support IT services.

  • Improve system reliability, performance, and security.

  • Communicate important service updates.

  • Send promotional materials, newsletters, or offers (only if you opt in, with the right to unsubscribe anytime).

  • Comply with applicable laws and regulations.

4. Data Sharing & Disclosure

We may share information in the following circumstances:

  • Service Providers: With trusted third parties such as SaaS vendors, backup providers, payment processors, contractors, or consultants engaged to assist with delivering services.

  • Legal Compliance: To comply with laws, regulations, legal processes, or government/law enforcement requests.

StarByte is not responsible for the actions, omissions, or policies of third-party service providers.

5. Data Security

StarByte implements industry-standard safeguards, including:

  • Data encryption (in transit and at rest).

  • Multi-Factor Authentication (MFA).

  • Secure baseline configurations.

  • Regular monitoring, patching, and updates.

⚠️ However, no system is 100% secure. StarByte does its best to protect client data but cannot guarantee protection against all breaches, attacks, or unauthorized access.

6. Data Retention & Deletion

  • We retain client data for 90 days after services end, after which it is securely deleted unless longer retention is legally required.

  • Clients may request deletion of their personal data at any time. We will comply unless retention is required for legal, billing, or security purposes.

7. Client Responsibilities

Clients are responsible for:

  • Safeguarding their own passwords, account credentials, and access controls.

  • Implementing reasonable local security measures.

  • Notifying StarByte promptly of suspected unauthorized access.

StarByte is not liable for losses arising from a client’s failure to follow secure practices.

8. Children’s Privacy

Our services are intended for individuals 18 years or older. We do not knowingly collect data from minors. If we discover that a minor’s data has been collected, it will be deleted immediately.

9. International Users

All data is processed and stored in the United States. By using our services, non-U.S. users consent to the transfer and processing of their information in the United States, subject to U.S. law.

10. Limitation of Liability

To the maximum extent permitted by law:

  • StarByte’s liability arising from or relating to this Privacy Policy is limited to the amount paid by the client for services in the twelve (12) months preceding the claim.

  • StarByte is not liable for indirect, incidental, or consequential damages resulting from unauthorized access, data loss, or third-party actions.

11. Indemnification

Clients agree to indemnify, defend, and hold harmless StarByte IT LLC, its owners, employees, and contractors from any claims, liabilities, damages, or expenses arising out of the client’s misuse of services, failure to follow secure practices, or violation of applicable laws.

12. Severability

If any provision of this Privacy Policy is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Policy Updates

StarByte may update this Privacy Policy at any time. Clients are responsible for periodically reviewing the policy for changes. Continued use of our services constitutes acceptance of the updated policy.

14. Governing Law

This Privacy Policy is governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Sacramento County, California.
