NATIONWIDE ONSITE SERVICES POLICY

This Nationwide Onsite Services Policy (“Policy”) governs all in-person services provided by StarByte IT LLC, a California limited liability company, doing business as StarByte (“StarByte,” “we,” “our,” or “us”), at Client locations anywhere within the United States (“Onsite Services”).

By requesting or authorizing Onsite Services, Client agrees to this Policy.

 

1. Nationwide Service Authorization

1.1 Client authorizes StarByte to perform Onsite Services at locations designated by Client within the United States, including residences, offices, commercial facilities, data centers, temporary sites, and event venues.

1.2 Client acknowledges that StarByte personnel may travel interstate to perform Onsite Services.

1.3 Nothing in this Policy obligates StarByte to provide Onsite Services in any specific location.

 

2. Governing Law & Interstate Application

2.1 This Policy, and all Onsite Services provided under it, shall be governed exclusively by the laws of the State of California, without regard to conflict-of-law principles.

2.2 Client agrees that California law shall apply regardless of the state in which Onsite Services are performed, to the maximum extent permitted by law.

2.3 StarByte will comply with applicable local safety and access regulations required to perform Onsite Services; however, such compliance does not alter the governing law or venue provisions of this Policy.

 

3. Scope of Onsite Services

3.1 Onsite Services may include, but are not limited to:

  • Hardware installation, repair, or replacement

  • Network setup, cabling, and diagnostics

  • System assessments and consulting

  • Software deployment and configuration

  • Troubleshooting and remediation

3.2 Onsite Services are limited to the agreed scope of work. Additional requests may require:

  • Written approval

  • Additional fees

  • A separate visit or agreement

 

4. Access & Work Environment

4.1 Client agrees to provide:

  • Safe, lawful, and unobstructed access to work areas

  • Adequate lighting, ventilation, and workspace

  • Reliable power and internet access, where applicable

4.2 Client must secure pets, children, and unauthorized individuals away from work areas.

4.3 StarByte may refuse, suspend, or discontinue Onsite Services if site conditions are unsafe, unsanitary, unlawful, or materially interfere with service delivery.

 

5. Safety & Hazardous Conditions

5.1 StarByte is not responsible for hazardous conditions existing prior to arrival, including but not limited to:

  • Faulty wiring or grounding

  • Structural defects

  • Water damage, mold, or environmental hazards

  • Excessive dust, debris, or unsafe installations

5.2 StarByte may immediately discontinue Onsite Services if unsafe conditions are discovered, without liability.

 

6. Client Property & Existing Damage

6.1 StarByte is not responsible for pre-existing damage to equipment, furniture, or property.

6.2 Client must identify fragile, sensitive, or restricted items prior to service.

6.3 StarByte is not liable for damage caused by hidden defects, aging infrastructure, or normal wear and tear.

 

7. Data Responsibility

7.1 Client is solely responsible for maintaining backups of all data prior to Onsite Services.

7.2 StarByte is not responsible for data loss or corruption arising from Onsite Services unless caused solely by StarByte’s gross negligence or willful misconduct, to the extent prohibited by law.

 

8. Scheduling, Travel & Fees

8.1 Onsite Services require confirmed scheduling.

8.2 Travel-related fees may include:

  • Travel time

  • Mileage, airfare, lodging, or transportation costs

  • Minimum service durations

8.3 Fees will be disclosed in advance through invoices, checkout screens, or written agreements.

8.4 Delays caused by Client access issues, site conditions, or unavailability may be billable.

 

9. Right to Refuse or Discontinue Onsite Services

9.1 StarByte reserves the right to refuse or discontinue Onsite Services if:

  • Conditions are unsafe, hostile, or unlawful

  • Requested services exceed the agreed scope

  • Client behavior is abusive, threatening, or inappropriate

  • Services would violate law or policy

9.2 Discontinuation does not waive payment obligations for services already rendered or incurred travel costs.

 

10. Limitation of Liability

10.1 To the maximum extent permitted by law, StarByte shall not be liable for indirect, incidental, or consequential damages arising from Onsite Services.

10.2 Any liability related to Onsite Services is subject to the limitations set forth in StarByte’s Limitation of Liability & Indemnification Agreement.

10.3 Nothing in this Policy limits liability for gross negligence or willful misconduct where prohibited under applicable law.

 

11. Venue & Jurisdiction

Any dispute arising from or relating to this Policy or Onsite Services shall be resolved exclusively in the state or federal courts located in Sacramento County, California, and Client consents to such jurisdiction.

 

12. Acceptance & Electronic Consent

By requesting or authorizing Onsite Services, submitting payment, or checking an agreement box, Client acknowledges that they have read, understood, and agree to this Nationwide Onsite Services Policy.

Client agrees that electronic acceptance constitutes a valid and legally binding electronic signature under the U.S. ESIGN Act and the California Uniform Electronic Transactions Act (UETA).
