This Hardware, Repair & System Build Disclaimer (“Disclaimer”) applies to all hardware-related services provided by StarByte IT LLC, doing business as StarByte (“StarByte,” “we,” “our,” or “us”), including but not limited to computer system builds, upgrades, repairs, diagnostics, part installation, component replacement, tuning, and optimization (collectively, “Hardware Services”).
By requesting, authorizing, submitting payment for, or accepting Hardware Services, Client agrees to this Disclaimer.
1. No Manufacturer Relationship
1.1 StarByte is not a manufacturer of hardware components and does not provide manufacturer warranties.
1.2 All warranties, guarantees, or support obligations for hardware components are provided solely by the original manufacturer or vendor.
1.3 StarByte does not guarantee manufacturer warranty approval, replacement eligibility, or RMA outcomes.

2. Client-Supplied Hardware
2.1 When Client supplies hardware, StarByte is not responsible for:

Pre-existing defects or wear
-
Incompatibility with other components
-
Counterfeit, modified, or previously damaged parts
-
Missing accessories, cables, or documentation
2.2 Client represents that all supplied hardware is lawfully owned and properly licensed.
2.3 StarByte reserves the right to decline installation of hardware that appears unsafe, incompatible, defective, or unsuitable for the requested Services.

3. StarByte-Sourced Hardware
3.1 Hardware obtained through StarByte is subject to availability and third-party supplier terms.
3.2 StarByte does not guarantee pricing stability, availability, delivery timelines, or continued supply.
3.3 Defective, DOA, or failed hardware components are subject solely to manufacturer or supplier warranty and return processes.
4. Compatibility & Performance
4.1 StarByte makes commercially reasonable efforts to assess compatibility at the time of service.
4.2 No guarantee is made that all components will function optimally together, particularly when mixing vendors, generations, firmware versions, or client-supplied parts.
4.3 System performance may vary based on factors including but not limited to:

BIOS or firmware limitations

Operating system updates
-
Software configuration
-
Thermal conditions and airflow
-
Power delivery and environmental conditions
5. Overclocking, Tuning & Modifications
5.1 Overclocking, undervolting, BIOS changes, or performance tuning are performed only with Client authorization.
5.2 Client acknowledges that such modifications:

May reduce hardware lifespan

May void manufacturer warranties
-
May introduce instability, crashes, or data loss
5.3 StarByte is not responsible for damage or failures resulting from authorized performance modifications.
6. Data Responsibility
6.1 Client is solely responsible for maintaining current backups of all data prior to Hardware Services.
6.2 StarByte is not responsible for data loss, corruption, or software issues resulting from:

Hardware failure or replacement

BIOS or firmware updates
-
Operating system reinstallation
-
Inherent hardware limitations
7. Used, Refurbished, or Legacy Hardware
7.1 Used, refurbished, discontinued, or legacy hardware carries increased risk of failure.
7.2 StarByte makes no guarantees regarding longevity, reliability, or future compatibility of such components.
8. Shipping & Transportation
8.1 StarByte is not responsible for damage occurring during shipping or transportation unless expressly agreed in writing.
8.2 Client is responsible for proper packaging, insurance (if desired), and carrier claims.
9. Physical Handling & Inherent Risk
9.1 Hardware services involve inherent risks, including potential damage to components, connectors, or housings.
9.2 StarByte performs Hardware Services using commercially reasonable care consistent with generally accepted industry standards.
9.3 StarByte is not liable for damage resulting from fragile components, hidden defects, aging hardware, or manufacturer design limitations.
10. No Guarantee of Repair or Build Outcome
10.1 StarByte does not guarantee that:

A device can be successfully repaired

A system will meet subjective expectations beyond agreed specifications

Issues will not recur due to underlying conditions
11. Limitation of Liability
11.1 To the maximum extent permitted by law, StarByte shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, loss of business, downtime, or loss of use, arising from Hardware Services.
11.2 StarByte’s total liability for Hardware Services shall not exceed the labor fees actually paid for the specific Hardware Services giving rise to the claim, excluding the cost of hardware components, except where liability results solely from StarByte’s gross negligence or willful misconduct.
12. Right to Refuse or Discontinue Service
12.1 StarByte reserves the right to refuse or discontinue Hardware Services involving unsafe equipment, suspected counterfeit components, unreasonable risk, or potential legal or safety concerns.
13. Legal Carve-Out
Nothing in this Disclaimer limits or excludes liability for gross negligence, fraud, or willful misconduct to the extent such limitation is prohibited under applicable California law.
14. Acceptance & Electronic Consent
By requesting Hardware Services, submitting payment, or checking an agreement box, Client acknowledges that they have read, understood, and agree to this Disclaimer.
Client agrees that acceptance through electronic means constitutes a valid and legally binding electronic signature under the U.S. ESIGN Act and the California Uniform Electronic Transactions Act (UETA).
Client further acknowledges that they have had the opportunity to review this Disclaimer, ask questions, and decline optional Hardware Services prior to acceptance.
